What is the process for filing a whistleblower claim?

In California, the process for filing a whistleblower claim is relatively straightforward. First, the person filing the claim must have knowledge of a wrongdoing committed by their employer. They must also believe that the employer is likely to continue performing this act if not held accountable. The whistleblower must then take their concerns directly to their employer first. If this does not resolve the issue, the whistleblower can file a complaint with the California Department of Industrial Relations’ Division of Labor Standards Enforcement (DLSE). The whistleblower should provide all the information requested by DLSE in the most concise, accurate, and complete form possible. This should include the name of the employer, their address, a description of the wrongdoing, and any other relevant documents. Once the complaint is filed with the DLSE, the investigator assigned to the case will review the materials and determine whether a violation of the Whistleblower Law occurred. If they find a violation, they will report it to the DLSE. The DLSE may then take action to bring the wrongdoer to justice, such as mediating between the employer and the whistleblower, issuing a citation and/or fine, or initiating litigation. If successful, the whistleblower may be eligible for rewards and compensation for their losses.
