What is the difference between wrongful termination and wrongful act termination?

Wrongful termination is when an employee is fired without legal cause. This can happen when a person is fired unjustly for a bad reason. For example, if an employee is fired because of their race or gender, this would be considered wrongful termination. Wrongful act termination is when the employer terminates the employee’s employment based upon their knowledge of that employee’s misconduct or other illegal acts. For example, if an employee is caught stealing from their employer and is fired as a result, this would be considered wrongful act termination. In North Carolina, wrongful termination is illegal and an employee can take action against their employer. Wrongful act termination is not necessarily illegal if the employer can prove that the employee was involved in illegal activities or misconduct that was related to their job duties. Therefore, it is important for employers to carefully document any misconduct or illegal activities that an employee is involved in so that they can protect themselves from a potential wrongful termination lawsuit.
