How do I prove that I was wrongfully discharged?

To prove that you have been wrongfully discharged in California, you must demonstrate that the employer acted in a manner that violated public policy or violated any section of the Fair Employment and Housing Act. In the event that you were wrongfully terminated for being a member of a protected class, such as race, religion, gender, or sexual orientation, you must show that your employer fired you because of your membership in the protected class. If the employer is claiming that your termination was due to performance, you must show that you were treated differently than other employees with the same level of performance. This can be done by gathering evidence such as emails, memos, or other documents that show how your employer treated other employees differently. You can also access information from your former employer including training records, job performance evaluations, and attendance records. Additionally, you can request to review the employee handbook and policies to see if the company violated any of its own policies in your termination. Finally, you can contact witnesses who work at the company or can provide testimony as to why you were wrongfully discharged. These individuals may have experienced or witnessed similar situations or may be able to provide an account of your work performance and behavior. This can provide valuable evidence in proving your case.
