What is the Packers and Stockyards Act?

The Packers and Stockyards Act is a federal law that provides protection to farmers and ranchers in the poultry and livestock industry in Virginia and throughout the United States. This law is designed to protect poultry and livestock producers from unfair trade practices, such as deceptive pricing and unjustly discriminatory treatment. The Act was put into place in 1921 in order to protect farmers and ranchers from potential abuses associated with large grain and livestock trading companies. The law requires poultry and livestock traders to register with the U.S. Department of Agriculture and maintain records of their business transactions. It also specifies that all payments for livestock and poultry must be made within a reasonable amount of time and that accurate, written records of all transactions must be kept. The law also provides for the inspection of poultry and livestock establishments and gives the U.S. Department of Agriculture the authority to investigate and prosecute violations of the law. The Act also prohibits sellers from discriminating against one another in the sale of poultry and livestock, and it requires that all poultry and livestock dealers engage in fair competition. Finally, the Act provides farmers and ranchers with a variety of remedies if the terms of a contract are violated including seeking monetary damages, the return of any wrongfully withheld payments, and or the return of unlawfully sold livestock. The Packers and Stockyards Act helps promote fair practices in the poultry and livestock industry, protects farmers and ranchers from unfair trade practices, and gives farmers and ranchers a variety of remedies if their rights are violated.
