What is sexual harassment?

Sexual harassment is a form of unlawful discrimination under Texas Employment Law. It is any unwelcome conduct that is based on sex, gender, or gender identity and expression. This can include, but is not limited to, inappropriate jokes, teasing, or behavior directed at a particular gender. It can also include physical contact such as unwanted touching or holding someone against their will, and using sexual language in the workplace. It is important to know what type of behavior is considered harassment, as Texas Employment Law considers any form of it to be illegal. This includes both verbal and physical harassment, such as jokes, behavior, comments, or requests of a sexual nature. Additionally, any verbal, physical, or visual conduct that creates a hostile work or educational environment is also considered sexual harassment. It is important to understand that when it comes to sexual harassment, it is not just up to the victim to report it. Everyone in the workplace, or educational setting, has a responsibility to report any form of harassment they witness. It is also important to note that employer’s should have a policy and procedure in place for specifically dealing with instances of harassment. These policies should clearly define what constitutes sexual harassment, and how it should be reported and handled.
