How many days of leave am I entitled to under the FMLA?
Under the Family and Medical Leave Act (FMLA), employees in Washington are entitled to twelve weeks of leave in a twelve month period. This applies to both part-time and full-time employees. Employees who are eligible for FMLA leave are those who work for companies with fifty or more employees, and those who have worked at their company for at least 12 months and have worked at least 1,250 hours in the last twelve months. The twelve weeks of leave can be taken for a number of reasons, including the birth of a child, adoption, caring for an ill family member, or the employee’s own medical needs. During the twelve weeks, employees are entitled to maintain their medical benefits and be paid for any vacation or other paid time off they have accrued. If the employee’s leave is due to their own medical needs, their employer is required to provide up to twelve weeks of unpaid leave. However, if the leave is taken because of an illness or injury of a family member, the employee is allowed up to 26 weeks of unpaid leave. In either case, the employee will have the right to return to their job or an equivalent position when they have finished their leave period.
