What is a Q visa?
A Q visa is a type of work visa available under the Immigration and Nationality Act (INA). It is reserved for those participating in an international cultural exchange program. The Q visa allows participants to take part in an employment-based cultural exchange program in the United States. The Q visa is sponsored by employers who must petition the U.S. Citizenship and Immigration Services (USCIS) for it. Companies must prove certain criteria to be eligible for a Q visa including that the exchange program is intended to promote the interchange of culture, history, and tradition between the United States and another country. The employer must also demonstrate that the employment is temporary and will not adversely affect the job of a similarly employed American citizen. Q visa holders are typically allowed to stay in the United States for a maximum of 15 months, although extensions may be granted in certain circumstances. They may only participate in their designated employment and cannot transfer to another job or employ others. Participants are also prohibited from conducting business or engaging in study outside of their designated activity without first obtaining a change of status. Q visa holders who wish to extend their stay beyond 15 months must obtain a new Q visa from their home country before re-entering the United States. Additionally, Q visa holders must continue to comply with all other immigration and labor laws associated with their visa status in order to remain in the United States.
