What is the union organizing process?
The union organizing process in Texas is a process by which a group of employees can collectively bargain with their employer through a formally recognized union. It begins when a group of employees—usually under the guidance of a union representative—expresses their desire to become unionized and negotiates a collective bargaining agreement (CBA) with their employer. The CBA outlines the rights and benefits of union membership, and the terms of employment, including wages, hours, and working conditions. The employees must then submit a petition to the National Labor Relations Board (NLRB) seeking official unionization. The NLRB then oversees an election in which the employees must vote for or against unionization. In order to win, the majority of employees must vote for unionization. If the election is successful, the union is officially recognized and can then negotiate a contract with the employer. This contract will set minimum wages, working hours, and other key employee rights, such as job security or paid vacations. The union has a duty to represent all of the employees—even if they are not members of the union. This means the union is responsible for protecting the rights of all employees and advocating for their interests. The union must also manage the terms of the contract and, if necessary, represent the employees in grievances or collective bargaining disputes.
