What is the Americans with Disabilities Act (ADA)?

The Americans with Disabilities Act (ADA) is a federal civil rights law that was passed in 1990. It prohibits discrimination against people with disabilities in the workplace, as well as in public accommodations, transportation, and telecommunications. The ADA also requires employers in Arizona to provide reasonable accommodations that enable disabled employees to do their jobs. The ADA defines a “disability” as a physical or mental impairment that substantially limits one or more major life activities. It also includes people who have a record of such an impairment or are regarded as having such an impairment. The ADA covers all public and private employers with 15 or more employees, as well as state and local governments. Employers in Arizona are required to provide reasonable accommodations to workers with disabilities. Reasonable accommodation can include making facilities accessible, providing interpreters or reader services, or adjusting work schedules. Employers must also provide reasonable accommodation for employees with disabilities to apply for jobs and to perform their jobs effectively. The ADA also requires employers to keep confidential any medical information obtained about an employee or job applicant. Employers may not ask job applicants about their disabilities or require medical exams prior to making a job offer. Federal and state laws provide for enforcement of the ADA. If employers are found to have violated the ADA, they may be liable for damages. Employees can file a complaint with the Federal Equal Employment Opportunity Commission or the Arizona Civil Rights Division if they feel their employer has violated the law.
