What are the rules regarding union organizing?

In Washington, labor relations are governed by the Washington State Public Employment Relations Commission (PERC). Under PERC, union organizing is allowed and is protected by Washington State Law. Organizing a union requires the efforts of workers to join together and form an organization. The rules regarding union organizing include obtaining authorization cards from a majority of the workers and filing a petition with the employer. The employer must then recognize and bargain with the union after a petition has been filed. Other rules regarding union organizing include the right of workers to discuss labor issues and the union organizing activities. Employers are not allowed to intimidate or threaten employees for their participation in union activities. Additionally, employers may not interfere with a union drive or discriminate against workers for their union activities or sympathies. Union organizing activities in Washington are regulated by the employers’ obligation to bargain in good faith. This means that employers must enter into negotiations for contracts and take into account the needs and interests of their workers. During negotiations, employers must meet certain requirements and be willing to compromise with union representatives. Finally, current and prospective union members in Washington are protected from unfair labor practices by the National Labor Relations Board (NLRB). Unfair labor practices include employers attempting to discourage union organizing or threats of reprisal against union members. If unfair labor practices are proven, the NLRB can issue a ruling requiring the employer to stop their activities.
