What is a labor arbitration hearing?

A labor arbitration hearing is a process by which a neutral third party, called an arbitrator, hears evidence from a labor union and an employer and then makes a decision about a dispute between them related to a collective bargaining agreement. This process is often used as an alternative to traditional litigation in order for the parties to quickly and cost-effectively resolve their disagreements. During a labor arbitration hearing, each side has the opportunity to present witnesses and documents in support of their position, and the arbitrator is allowed to ask questions. After both sides have presented their evidence, the arbitrator will make a decision, or ruling, based on the evidence presented and the policies of the collective bargaining agreement. This ruling is called an “award” and is legally binding on both parties. In Washington, certain labor disputes are required to be settled by arbitration. The Washington State Labor Council is the primary entity responsible for administering labor dispute resolutions through arbitration. The organization can offer guidance and assistance to labor unions and employers on arbitration matters, including helping them find a qualified arbitrator.
