Are employers required to provide a rest break and/or meal break?

In North Dakota, employers are required to provide both a rest break and a meal break for their employees. The North Dakota Department of Labor and Human Rights states that all employers must provide a rest break of at least ten minutes after their employees have been working for two hours. During this rest break, employees must be relieved of all work duties. Additionally, employers must provide a meal break of at least thirty minutes after their employees have been working for five hours. During this meal break, employees must also be relieved of all work duties and cannot be disturbed. While employers are not technically required to pay employees for their rest or meal breaks, if they do so the break must count as hours worked and must be compensated at the employee’s regular rate of pay.
