What is the Americans with Disabilities Act Amendment Act?

The Americans with Disabilities Act Amendment Act (ADAAA) is a federal law passed in 2008 that seeks to protect the rights of individuals with disabilities in California, and throughout the US. The ADAAA prohibits discrimination based on an individual’s disability and requires employers to make reasonable accommodations for individuals with disabilities. The ADAAA applies to all employers that are considered “covered entities.” This means that any employer with 15 or more employees must adhere to the requirements of the ADAAA. Additionally, any state or local government, employment agency, labor organization, joint labor-management committee, and private employment agency, and private employer is also considered a “covered entity” and must comply with the requirements of the ADAAA. The purpose of the ADAAA is to expand the definition of “disability,” making it easier for individuals who may be disabled to receive the protections afforded by this law. This means that instead of having to prove that an individual’s disability is severe enough to qualify for legal protection, they need only show that they have an impairment that limits one or more major life activities. The ADAAA also established procedures for employers to provide reasonable accommodations to individuals with disabilities in the workplace. This includes making accommodations such as providing accessible furniture or making changes to job duties so that a disabled individual can perform them. The goal of the ADAAA is to ensure that individuals with disabilities are treated equally in the workplace and are able to receive the accommodations that they need to make their job as accessible as possible. This law is one of several civil rights laws that seeks to protect the rights of individuals with disabilities in California.
