What is a change of status?

A change of status is a process by which an individual can obtain legal permission to live and work in the United States. This is usually done through the United States Citizenship and Immigration Services (USCIS). For immigrants with a valid nonimmigrant visa, such as an F-1 student or J-1 exchange visitor visa, a change of status can provide a pathway to permanent residence. In Washington, immigrants can apply for a change of status if they meet certain criteria, such as eligibility for employment-based immigration and having a viable job offer from a U.S. employer. To apply for a change of status, an immigrant must first file an I-129 form with the USCIS. Once the form has been approved, the immigrant will gain a new immigration status and can begin working in the U.S. This is a useful option for those who do not qualify for permanent residence and have work authorization in the country. It is important to note, however, that any change of status application can be denied if the criteria are not met or if certain information is not provided.
