What is the Minimum Wage Act?
The Minimum Wage Act is a collection of state and federal laws that govern minimum wage, overtime pay, and other labor standards for California workers. The federal Minimum Wage Law, which is part of the Fair Labor Standards Act (FLSA), sets the minimum wage in the United States and is enforced by the U.S. Department of Labor. The California Minimum Wage Act (CWMA) is a state law that sets the minimum wage for California employees and is administered by the California Department of Industrial Relations (CDIR). The current minimum wage in California is $12.00 per hour for employers with 25 or fewer employees, and $13.00 per hour for employers with 26 or more employees. In addition, employers must pay employees at least one and one-half times their regular rate of pay for any hours worked over 40 in a workweek. The CWMA also sets other labor standards, such as meal and rest break requirements and limits on the number of hours an employee can work in a day. The CWMA also requires employers to provide additional compensation (such as overtime pay) or other accommodations to employees who are affected by illnesses or disabilities. The CWMA is enforced by the CDIR, which has the power to investigate complaints and initiate legal action against employers that violate the law. The Employer Liability Litigation Unit at the CDIR also has the authority to order employers to pay damages to employees for wages found to be owed under the law.
