What are the requirements for having a work week?

In Virginia, the requirements for having a work week are outlined by the Wage and Hour Law. Generally, a work week consists of 7 consecutive 24-hour periods, beginning on the same day each week. Employees must receive the same day off each work week, although it does not necessarily have to be a weekend day. Wage and Hour Law in Virginia states that the work week can be extended up to 8 days but only if the employer and employee agree to it in writing. The extended work weeks can also be tapered, meaning that the employee must receive at least one day off for every 7 days worked. Employers are also required to pay overtime wages, which are any hours worked over 40 hours during the week. Overtime wages must be paid at 1.5 times the regular rate of pay and must be paid within 10 days of the wages being earned. Finally, the Wage and Hour Law requires employers to provide their employees with at least 10 consecutive hours off between shifts. This means that an employee must be given 10 hours off before they begin their next shift. Any hours worked during this rest period must be paid at a rate of twice the regular rate of pay.
