What are the rules for paying overtime?
In Virginia, the state’s wage and hour laws require employers to pay overtime for any hours worked over 40 in a given week. For example, if an employee works 42 hours in a week, they must be paid overtime for the two extra hours. Overtime is calculated by multiplying the regular rate of pay by 1.5. For some employees, overtime pay is not required after 8 hours per day. This includes police officers, firefighters, emergency medical services personnel, nurses, and other health care workers, who are protected by the Commonwealth of Virginia’s Fair Labor Standards Act. Additionally, some employees are exempt from overtime pay requirements. These include independent contractors, certain seasonal and agricultural workers, and employees of certain small businesses. The law also exempts specific types of employees, such as certain computer professionals, outside salespersons, and some administrative employees. All in all, the main rule for overtime pay in Virginia is that any hours worked over 40 in a given week require the employee to be paid overtime.
