What is the overtime threshold for salaried employees?

In Virginia, salaried employees must be paid overtime when they work more than 40 hours in a one-week period. This applies to salaried employees that make less than $684 per week ($35,568 per year). If an employee makes more than this amount, there is no overtime pay requirement. An employee’s salary must also be paid for any week in which the employee performs any work, regardless of how many hours are worked. In Virginia, employers are also required to pay overtime for any time worked over 8 hours in a day. In addition, employers must pay double time for any time worked over 12 hours in a day. Note that there is no state law that requires employers to pay overtime for time worked over 8 hours on a Saturday or Sunday. If an employer fails to pay an employee the overtime wages they are due, they can file a wage claim with Virginia’s Department of Labor and Industry. Employees have the right to receive back pay for the time they worked but were not paid overtime wages for. It is important to know your rights under Virginia’s Wage and Hour Law.
