Are employers required to provide employees with work breaks?

In Virginia, employers are generally not required to provide employees with work breaks. However, some exceptions do exist. For example, employers who employ minors under the age of 18 must provide at least a thirty-minute break for each four hours worked. The break must be unpaid and given in the middle of the work period. Additionally, employers must provide a two-hour break every day for minors who work more than five hours. Employers must also provide a break to nursing mothers who request to express milk. The break should be given whenever is necessary during the workday and as often as needed. The break should last for as long as needed for the employee to express milk and must be unpaid. Finally, employers must provide an unpaid break of at least 30 minutes in duration when employees work more than six hours in a single shift. Though employers in Virginia are generally not required to provide employees with work breaks, there are certain exceptions. Employers should always be mindful of these regulations when dealing with minors, nursing mothers, and employees working more than six hours in a single shift.
